Overview

Michael practices in the Columbia Business Section and works primarily with distressed companies and financial institutions in out-of-court restructurings, Chapter 11 bankruptcy cases, and related litigation and transactional matters. Early in his career, Michael focused his practice almost exclusively on representing financial institutions in commercial bankruptcy cases and workouts. In the past 10 years, Michael has broadened his practice to include the representation of several distressed companies in Chapter 11 bankruptcy cases and out-of-court restructurings.

 
Representative Engagements

  • Co-counsel to the ad hoc committee of term lenders in the Chapter 11 case of a 215 store grocery chain.
  • Represented the official committee of unsecured creditors in the chapter 11 case of a 500 employee Charleston, South Carolina manufacturer of mine resistant ambush protected vehicles.
  • Served as debtor’s counsel in the Chapter 11 bankruptcy case of a 500 employee, $225 million steel mill located in Georgetown, SC.
  • Served as debtor’s counsel in the Georgia Chapter 11 case of a 900 employee, $150 million paper mill located in St. Mary’s, Georgia.
  • Served as co-counsel to the unsecured creditor’s committee in the Chapter 11 case of an international manufacturer of non-woven fabric which successfully restructured over $600 million in debt and emerged from Chapter 11 in 2003.
  • Served as Debtor’s counsel in the Delaware Chapter 11 case of a regional textile manufacturer which operated plants in five states with approximately 5,000 employees.
  • Served as co-counsel in the Chapter 11 case of a large resort hotel in South Carolina in which many significant reported decisions were issued regarding Chapter 11 confirmation requirements and lease rejection issues.
  • Represented the primary lender in the Chapter 11 bankruptcy case of a government security provider.
  • Served as co-counsel for the debtor in the Chapter 11 case of one of the country’s largest restaurant operators in which over $1 billion in debt was restructured.
  • Served as co-counsel for the debtors in the Chapter 11 bankruptcy case of a golf course resort community developer with liabilities of approximately $1 billion and operations in South Carolina, Florida, Louisiana, Oklahoma, California and Arizona.
  • Represented numerous financial institutions, insurance companies and other secured creditors in Chapter 11 bankruptcy cases, out-of-court restructurings, and workouts since 1986.
